I signed a contract with Juan Carlos Penagos for repairs at home after freeze. He always lied and never worked on time. In multiple occasions we had to stay home to accommodate him and still never showed up. He left the project in the middle and never completed. The contract was supposed to be 10 days and he took over 4 months and then abandoned it. I took a loan to pay him and he ran away with money. His business address is also incorrect. I was referred to him via pro referral at Home Depot. I filed complaints against him and have not received any response. I am down 10K. Please beware.

DISPUTE - CONTRACTOR ABANDONMENT / INVOKE THE CONSUMER PROTECTION ACT, 1986 / SEEKING COMMUNITY ASSISTANCE
I wish to solicit your assistance as a consumer who has been violated, exploited, preyed upon, and taken advantage of by a construction company that abandoned a renovation project with less than 10% of the work completed but took 60% of my money($37,500) leaving me as a single elderly female living in a hazardous construction zone inside my own home and held hostage in her own house to the demands of a company and owner of the company refusing to abide by their own contract. During this COVID-19 Pandemic, I am isolated due to my age from family and friends. My health is comprised resulting with the need to be ultra-careful and I wanted to make upgrades to my home and expand with an addition. I appeal to your organization, and I plea for your assistance to rectify the emotional and financially compromised situation put on me by Mr. Carlos Penagos and his family and his company Picasso Painting & Remodeling Co that I entered into a contract with July 9, 2020. His failure to keep his promise and commitment to complete the renovation project at the above address of around 60 days of 100% satisfaction not only endangered me physically, but the emotional toll is unfathomable. There are not enough words to describe the intensity of this unnecessary situation that could have easily been avoided if Mr. Carlos Penagos is a decent, law abiding, Professional Upstanding Business Man in the DFW Area and Miami Florida area he proclaims to be. Here is a summary of what has now put me, an elderly female, in an emotionally distraught, physically endangered, and financially devastated situation. After Mr. Penagos and I negotiated an amicable fee for renovations, a signed contract got done between myself and Mr. Carlos Penagos on behalf of his company, Picasso Painting & Remodeling Co, on July 9, 2020 (see attached executed agreement). Work began shortly afterward on the interior, with his son Carlo Penagos overseeing the project. After four weeks of work on the interior, Mr. Penagos demanded the second installment payment. This is written in the contract; however, they had completed approximately 5% of the interior project. Both father and son communicated they started the process to obtain a city permit for the build-out. However, nothing on the outside initiated as they communicated the city of Fort Worth, Texas, is slow due to COVID; it was difficult to obtain a city permit. When I asked about the delays, Mr. Carlos Penagos communicated the project is taking slightly longer than anticipated as the contract had an estimate of 60 days to complete the entire project. At this point, four weeks passed and the second installment is due. However, because I signed the contract which includes the second installment is due now, I conceded and made that second payment because I am an honest and honorable elderly woman of the community, upstanding citizen but with minimal financial resources. Many amenities on the master bathroom renovations I paid out of pocket, and Mr. Penagos agreed to take those costs off the final payment upon completion - essentially reducing the final amount as an offset. I took this approach because I could not get him or his Team to purchase items such as the shower faucet and shower door. When approximately 60 days passed and no Forth Worth City Permit was presented; Mr. Vetter and I spoke with Jacky Penagos (daughter of Mr. Carlos Penagos), and to our dismay, no progress to obtain the permit was found. I took it upon myself to contact the city permit office. After having several scheduled calls with the City of Fort Worth, we discovered that Mr. Penagos' company failed to provide the required documents to obtain a city permit, even after the city notified him multiple times detailing what is needed. Because the renovation is now significantly delayed, I pursued conversations with Mr. Carlos Penagos on the progress or lack of on the project during the next four weeks. On 10/19/20, Mr. Penagos removed the city trash bin from the property to my shock and dismay. He nor his crew returned to do any additional work - walked off the job and held me, hostage, for any continued work until I succumbed to pay additional money for the renovations with a new revised contract significantly higher than the original agreed upon signed contract. A contract that I did a cash-refinance on my house to pay the cost of the renovations. At this point, conversations with me shut down, and Mr. Penagos REFUSED to converse with me and would only converse with Mr. Vetter. Mr. Penagos demanded more money and wanted a new contract signed. I had another contractor assess and review the work completed, and he advised 10% of the proposal is complete. Three weeks ago, and after numerous conversations between Mr. Vetter and Mr. Penagos, Mr. Penagos refused to honor his and his companies commitments or deadlines he has made. I have found his professionalism to be lacking, and we as a community should work together to expel predators such as Mr. Penagos that seek out and prey on our most vulnerable. We as a community cannot continue to allow him and his family and company to do business and exploit others. I am appealing for assistance with this situation a very much appreciate your help. Ø NOVEMBER 9, 2020 Mr. Carlos Penagos demanded a new contract with an additional $29,200 tied to the original signed contract of $60,000.00 - TOTAL BID: $89,200.00 (LABOR AND MATERIALS) AMOUNT PAID $38,500 AMOUNT DUE: $50,700 $25,700 payment by signing revised contract, $15,000 after demo of concrete, framing & roofing, $10,000 final payment after windows, drywall & painting (upon completion) When we asked Mr. Penagos to honor the original contract we ALL signed and agreed to dated July 9, 2020; he became verbally abusive and threatening. This is recorded and is available upon request. My Desired Resolution: Ø I am asking for a full refund of the $37,500 paid to date Ø $6,000 for materials he had me buy on his behalf. Ø Pay for damages to a separate room of the house totaling just over $3,000 Ø Return the French doors I purchased and the item MUST be in the condition it was picked up from Builder's Surplus(new and no damage). Ø $5,000.00 floor damage in the Master Bedroom, Master Bathroom and Closet Ø $100,000.00 for the pain and anguish Mr. Carlos Penagos and his company inflicted I am enclosing multiple documents; however, text transcripts can be provided as well as recorded conversations with Mr. Penagos. Contacted Picasso Company insurance only to be notified the policy has lapsed and I have no other recourse. This experience has taught me well and I will never every use Thumbtack services again.

I received a favorable estimate from Carlos Penagos, which included a number of punch list items of my home. The estimate also included the matching the paint, painting living and dining rooms baseboards, patching pop-outs and settling creaks repairs using tape (no tape was used), plus painting walls supplying the paint (only bought one gallon initially), not having the correct equipment to do the job. None of this was done correctly and now my house is a complete deserter with two-tone walls and ceiling, paint splatter on wooden floors, cabinet's and furniture . I was better off before Picasso Company and your subcontractors came into my life ripping me off. SCOPE OF WORK: (PAINTING) 1. Paint interior of home DESCRIPTION: ( COVER FLOORS) 1. Painting entry way ceiling and second floor repair cracks. ( tape and bed and texture) 2. Painting wall stairway. 3. Painting office ceiling and one wall. 4. Painting kitchen and living room ceiling with repair cracks. ( tape and bed and texture) 5. Paint media room ceiling and repair nail holes. 6. Bedroom repair ceiling and paint ceiling. 7.
