Using Cancer diagnosis as reason not to pay Uninsured Motorist Coverage Claim

After 2 long years of legal battles over injuries I sustained in a car accident on 1/11/11, we finally had our arbitration meeting today. "LIKE A GOOD NEIGHBOR, STATE FARM IS THERE"......BULL ***! Because the kid that hit me was not insured, I was forced to go after my "Uninsured Motorist" coverage with my insurance, State Farm! For those that don't know what that is, it is the amount of coverage you pay exorbitant premiums for to cover yourself and your family in case you are hit by an uninsured person. I believe that the minimum amount of coverage you are REQUIRED to carry in Utah is $25,000.00, but you can go as high as $500,000.00. The more coverage you want the higher your premiums will be. I was at a complete stop waiting for an oncoming car to pass so that I could make a left hand turn into a parking lot and was hit from behind by a distracted 17 year old driving a full size GMC truck doing 45mph. My vehicle sustained $8,000.00 in damage. I sustained a concussion, a labral tear in my right shoulder, central disc herniations at C4-5 and C5-6 along with disc herniations at L5-S1. To correct these injuries, I will require an anterior cervical discectomy and fusion at C4-5 and C5-6 as well as either a microlumbar discectomy at L5-S1 on the left and/or possibly anterior posterior spine reconstruction at L5-S1. My uninsured motorist coverage was $100,000.00, my current medical expenses to date excluding these surgery's are $28,764.63. I have spent the last two years fighting for the coverage limits of $100,000.00 that I have paid my monthly premiums on to State Farm for the last 16 years, on time, every month. I have never had a ticket, never had an accident, never filed a claim. The estimated costs of the surgery's is $211,900.00. Mark Dunn, the attorney for State Farm claims that I suffered a lumbar strain as a result of this accident, and even more disturbing is the fact that he stated under oath that it is his opinion that I will never have the surgery because I am dying of breast cancer. Well let me tell you...I AM NOT GOING THROUGH THE *** OF CHEMOTHERAPY AFFECTIONATELY KNOWN AS "RED DEATH", A DOUBLE MASTECTOMY AND 25 DOSES OF RADIATION FOR ANY OTHER REASON THAN TO LIVE! How this man can look himself in the mirror and be proud of what he does is beyond me, but you can rest assured that I hope he gets everything he deserves in life! FYI...STATE FARM AND ALLSTATE ARE TWO OF THE WORST INSURANCE COMPANIES TO PAY YOU FOR ANY INJURIES YOU MIGHT SUSTAIN IN A CAR ACCIDENT! We have changed insurance carriers and are getting twice the coverage for half of the premiums we were previously paying. PLEASE PASS THIS ALONG TO YOUR FRIENDS AND LET PEOPLE KNOW WHAT TRUE SLUGS REPRESENT STATE FARM AND GET PAID TO INSURE THAT YOU DO NOT GET WHAT IS RIGHTFULLY YOURS!
