Won't say paid in full - FYI

I just did a recent complaint with the CFPB, Big Picture Responded but is still asking me to pay back part of the loan - FYI. Florida Office of Financial Regulation says the loan is totally unenforceable as they are not licensed in Florida, so even though Big Picture may want to claim they can pursue me, technically they cannot in Florida. BTW, I have had about 4 loans in the past with them and overpaid $400 in interest in fees -- their response to that, they don't have to pay that back which would basically cancel out what they are asking for me. It appears from my review of the CFPB website that there are now tons of complaints against Big Picture. Big Picture even has a very nice tribal legal sounding letter. So I guess if I ever head to their tribal area in North Michigan I'm doomed. LOL. My guess is that they will soon change their name again!!

Big Picture is a loan shark company

Thank going thru the same issue . I will be filing a complaint also and FYI to all you stop payments to them thru your bank . A ach stop payment is 29.00 well paid to keep from paying these people. I borrowed 400.00 also and would have been stuck paying back 2,300.00. 596.6755% apr. I made five payments and got into accident called to see what my options were and was basically told the f u pay me speech . I figured I was gonna end up on the streets then I spoke to a friend who is a lawyer and he gave me the option to stop paying file a complaint. I don't feel bad at all in do so cause paying back a 1000 bucks on a 400 dollar loan is more then good on my and conscience.

A REAL LIFE SAVER

This post Literally saved my life and saved me Hundreds of dollars! I borrowed $400.00 with a finance fee of $200.00, It was a bit steep but I was in a desperate situation. I made my first payment with an additional $50.00 to lower the amount and pay the loan off sooner.......Well low and behold I still owed these crooks $1,900.00! I followed the instructions on this post and I didn't have to file a complaint! I did use the Tactics on this post however for bargaining power and it worked! I am going to pay them $380.00 because I do owe them and KARMA is real. Thanks for posting and God Bless

Red Rock Tribal, Castle Payday, and now Big Picture Loans. You have free legal recourse

Tribal Lending does not mean they don't have to follow the law: Please read to the end, you do have a legal option to resolve this with the help of the Federal Government. This company is Red Rock Lending, It goes and has gone under multiple names, Castle Payday, and has now changed its name to Big Picture Loans. Avoid at all costs I made the mistake of taking a loan out with these scam artists, I was approved for a $600.00 loan, but only borrowed $350.00. I was told by the Rep on the phone that there would be a $122.50 finance charge, steep, but I agreed. What I did not know, and could not see at the time I accepted this agreement, was that the Truth in Lending disclosure not visible at the time I accepted this loan showed an APR of, and this is not a typo either, 849.0116% and that the total repayment amount for my $350.00 loan would be a whopping $1,872.50. After realizing what I had gotten myself into, I started looking online and saw what kind of company this is, they are a predatory lender engaged in illegal business practices. This is where it got interesting, I did digging online, and found that they are NOT immune to the reach of the Federal Government. On March 19th of 2014 U.S. District Judge Gloria M. Navarro ruled that the FTC Act “grants the FTC authority to regulate arms of Indian tribes, their employees, and their contractors.” specifically regarding deceptive payday lenders hiding behind a tribal affiliation.” I filed a complaint with the Consumer Financial Protection Bureau on December 8th citing what exactly had transpired, noting that I had not been informed of the 850% interest rate on the loan, that I was told there would be a $122.50 finance charge, not $1,872.50 in total payments, and that I was unable to view the "Truth in Lending" disclosure until after the loan had been processed and funds delivered to my account. This is illegal, and remember, their claim that they immune to the laws of the Federal Government….. is totally false. Within 10 days of me filing my complaint with the Consumer Financial Protection Bureau, I got a response from Castle Payday stating that "By electronically signing the loan agreement, you agreed to abide by its terms, including the repayment schedule." The very next paragraph however read... "To date, the Company has received payments from you in the amount of $490. While not obligated to do so, and in an effort to resolve this in a manner that is most favorable to you, the Company has “Charged Off” your account and updated its status to “Paid in Full,” thereby concluding your business with the Company." I had no problem with paying the total of $472.50 I had agreed to for the $350.00 loan, which is only fair, I was not looking to get out of a legitimate debt. I was fortunate, the $490.00 this cost me was only $17.50 more than I had expected to pay, and I will gladly write that off as a fee for learning this lesson. If you have been scammed by these people, I urge you to please go to the "Consumer Financial Protection Bureau" website, it is http://www.consumerfinance.gov/ and file a proper complaint. This doesn't cost anything. Include specific details of the loan, the illegal interest rate that they are attempting to charge you, whether or not all of the details of the loan were made visible to you at the time of the loan submission, etc. Be professional, and you will likely get the resolution that you are looking for. These complaints are forwarded to the legal offices of this illegal loan sharking operation and they will likely do what they can to make you happy and keep the Federal Government out of their operation as long as possible. Do not bother with the Better Business Bureau, they do not have legal authority over any company, go straight to the Feds. It took less than 10 days for me to get this resolved, this company does NOT want the feds coming after them, and the more people that file proper complaints, the more likely the FTC or CFPB is to take action against them to stop these illegal practices, These “Tribal Operations” have already been fined Millions by the feds. Here is the company full name and mailing address that you will need when you file your complaint: Red Rock Tribal Lending, LLC d/b/a CastlePayday.com (or now bigpictureloans.com) P.O. Box 704, Watersmeet, MI 49969

SCAM FRAUD PAYDAY LOAN is really what CastlePayDay is about

My letter claimed this was not a payday loan. That CastlePayDay was a real loan with payments. I applied online. My approved completed application online indicated my $800.00 loan would cost me $1080.00 and it was to be paid over 4 payments. Customer Service called before I could print out loan document. While on phone with her I found out it was 21 payments for a total of $6K. Yup whatever I saw online was bogus and "real loan" was 21 payments totaling $6,000.00 and first 5 payments were $400.00 and all INTEREST. Even though what I saw online within my application stated 4 payments and total of loan due was $1,080.00 that was ONLY IF I paid it off in 30 days. THAT is a payday loan. Now this crook has all my personal info. CastlePayDay are SCAMMERS and FRAUDS. CastlePayDay is a PAY DAY LOAN. If you want to take advantage of their bogus "real loan with real payments" you will be soaked. With my "castlepayday loan" my first 5 payments were all interest and essentially I was receiving $800.00 loaned to me and they take advantage of my cash need by making their loan into a hostage situation where I would be paying the $800.00 back to them with $400.00 monthly payments for the first 5 months ***BEFORE** I even got to paying off the actual loan which also had interest charges. So if you go the route of "real loan with real payments" I would have paid $2,000.00 over 5 months all in interest (for the $800.00 money I received) THEN I could begin repaying the loan. So in other words their loans hold you hostage to them for years. What is sickening is many people are desperate for the money and enter into this hoping they can pay it off in a month and if they don't they are soaked. This is CRIMINAL

Overpayment

I borrowed $800 dollars from them in July and I've paid them back over $3,000 so far and I still owe? The only way you can make payments is by calling them two days before your payment due date to "setup" how much you want to pay. You're making these $300 payments and they claim that is only for "finance fee" and not applied toward the actual loan amount. At that rate you will NEVER pay off the loan! This company needs to be investigated! They are ripping people off big time! So I'm paying them back more than what I borrowed, this is ridiculous! As previously stated, I borrowed $800 and in the end I will have paid almost $4000 back to them. This has to be illegal! No other loan company does this ***. I am in financial ruin over this! Never ever again will I use this company and I will warn everybody NOT to use this company ever. Nobody who works there speaks English well either, you have to ask them to repeat things constantly as well!
